General Terms and Conditions of Use

1. These General Terms and Conditions of Use govern the use by third parties of the content (i.e. images, videos and graphics) of the image, video and graphics archive of Gstaad Saanenland Tourism (accessible via gstaad.ch), especially with regard to accessing, downloading and using this content. The downloading and use of the above-mentioned content is subject to acceptance of the General Terms of Use, which also apply to all future use or editing of the photos, videos and graphics.

2. Gstaad Saanenland Tourism hereby grants its partners a simple, non-transferable and free licence to use the content of its image, video and graphics archive for the purpose of advertising products and services related to tourism in Gstaad.

3. Gstaad Saanenland Tourism or the owners of the corresponding rights retain the copyrights to the works from the image, video and graphics archive. Users of the archive are only granted the right to use these photos, videos and graphics within the framework of these General Terms and Conditions of Use.

4. The purpose of using the images, videos and graphics is explicitly limited to the promotion of products and services related to Gstaad tourism. Any use of the content in connection with offers not related to tourism is therefore prohibited or requires the express permission of the copyright holder/photographer and is subject to a fee.

6. Any use of images, videos and graphics must be labelled with the appropriate copyright, i.e. ‘Destination Gstaad/photographer’. The font size must be chosen such that the name of the photographer can be easily read.

7. To the extent permitted by law, Gstaad Saanenland Tourism accepts no liability for the unauthorised use of content from the image, video and graphics archive.

8. Images, videos and graphics from the image, video and graphics archive of Gstaad Saanenland Tourism may not be altered, falsified or manipulated using image editing programs (with or without the use of artificial intelligence) or other means in such a way that distorts their meaning. The central message of the image must always be retained. Users are only permitted to feed content from the image, video and graphics archive into artificial intelligence applications (e.g. DALL-E) under the aforementioned conditions.

9. Any use of photos, videos and graphics from the image, video and graphics archive of Gstaad Saanenland Tourism that does not comply with the purpose described in Section 4, or any other violation of these General Terms and Conditions of Use or the applicable law, will result in the immediate blocking of access to gstaad.ch and the loss of the granted right of use as defined in Section 2.

10. These General Terms and Conditions of Use for using the image, video and graphics archive of Gstaad Saanenland Tourism are subject to Swiss law. The exclusive place of jurisdiction is Thun, Switzerland.
